Kelantan prince, Tengku Muhammad Fakhry Petra files RM150 million wrongful confinement suit against Malaysian police

Kelantan prince Tengku Muhammad Fakhry Petra is suing the Malaysian police for RM150 million for wrongfully confining him by stopping him from sending a Bentley Brooklands car to his father.

He is seeking RM100 million in general damages, RM50 million in aggravated and exemplary, interests, costs and any relief deemed fit by the court.

Tengku Muhammad Fakhry said Friday he decided to sue the police because what had transpired during the incident in 2009 was “grave injustice" and "unprofessional”.

“I have to take legal action on the basis of justice and fairness as it is my right as a Malaysian to do so according to law,” he told the Malaysian media in Kuala Lumpur.

However, the prince said he have no ill feelings or negative views against the police.

The prince filed the suit at the Kuala Lumpur High Court civil registry through hislawyers Datuk Harpal Singh, A.S. Dhaliwal, Devinder Kaur Dhaliwal.

In the statement of claim, the prince named Inspector-General ofPolice Tan Sri Ismail Omar, then Kelantan Sultan's chief personal bodyguard ASP Norazman Ismail, Kelantan police chief Datuk Abdul Rahim Hanafi and the Royal Malaysian Police Force (PDRM) as defendants.

In his suit, the prince said that he was requested by his father, then Kelantan Ruler Sultan Ismail Petra on Aug 30, 2009 to send a Bentley Brooklands car to Singapore as he was seeking medical treatment there.

However, the prince said he was stopped by police at Istana Mahkota Kubang Kerian while he was driving the car, accompanied by his lawyer Datuk Mohd Haaziq Pillay, towards the palace's gate.

Tengku Muhammad Fakhry said about 20 to 30 policemen were outside the palace gate to stop him from leaving its compound with the car, adding that he would show the video recording during the trial to prove his case.

In elaborating, the prince said the defendants had wrongly detained him while carrying firearms meant to cause him fear.

Besides that, the prince said he had been detained by five policemen for an hour, which also caused him to suffer emotional disturbance, anxiety, mental stress and humiliation among the royalty.

He said the confinement was wrong under the law and unconstitutional.

The prince is a brother of Kelantan Sultan Tengku Muhammad Faris Petra.


Manohara Odelia Pinot

The prince hit the headlines a few years ago over his domestic dispute with his estranged wife Indonesian model Manohara Odelia Pinot who had accused him of abuse.

He has denied those allegations.

On November 11, 2011, Tengku Muhammad Fakhry Petra also made headlines when he sued the publisher of the Malay Mail and three others for allegedly implying that he was involved in a conspiracy to assassinate his brother.

Tengku Muhammad Fakhry filed the defamation suit at the Kuala Lumpur High Court civil registry on the 42nd birthday of his brother and Kelantan ruler Sultan Muhammad V.

Tengku Muhammad Fakhry said he just wants the truth to prevail.

“I am suing them as there was no attempt to meet up or make an apology (over the publication),” he said.

The prince filed the claim at the High Court civil registry through his lawyers – Datuk Harpal Singh Grewal, A.S. Dhaliwal and Devinder Kaur Dhaliwal.

Devinder said that the prince was seeking RM50mil in damages as the publisher had failed to remove the defamatory article which is still available via Malay Mail online.

In the lawsuit, he has named Malay Mail Sdn Bhd, its printer The New Straits Times Press (M) Bhd, its chief editor Yushaimi Maulud Yahya and its journalist as defendants.

In the statement of claim, the prince said that the article published by the Malay Mail online on May 5th, 2010 had violated his good name and reputation.

The prince said the words meant that Kelantan palace security guard Ramli Mohamed was targeted by him and had been shot because he knew about the plan to assassinate his brother, who was then Kelantan Regent known as Tengku Muh­ammad Faris Petra.

The prince said he did not take any immediate action as he was waiting for the coroner’s verdict regarding the death of Ramli.

The court had since returned an open verdict which showed he was not involved in any criminal activity, said Tengku Muhammad Fakhry.

Besides that, he said he had never been charged by the police over the incident.

He said Malay Mail Sdn Bhd had failed to verify the truth of the facts and allegations before publishing the article.

Kelantan Juara Liga Super 2011, tewaskan Sabah 2-1

Kelantan Juara Liga Super 2011 selepas menewaskan Sabah 2-1 dalam perlawanan terakhir di stadium Likas, Kota Kinabalu pada malam Rabu 6 Julai 2011. 15 ribu penonton menyaksikan perlawanan itu termasuk 5 ribu penyokong setia Kelantan The Red Warriors.



Penyerang Kebangsaan dari Kelantan, Noorshahrul Idlan Talaha menjaringkan kedua dua gol Kelantan pada perlawanan itu diminit ke 5 dan 71. Selepas perlawanan Noorshahrul berkata :

"pertama saya bersyukur dan alhamdulillah, sebab kelantan juara liga super pada tahun 2011 ini, pasal yg kasut emas tu, saya sikit kecewa utk tak dapat sebab second, tapi walau bagaimanapun saya penjaring terbanyak itu sebab tak dapat, itu pembakar semangat saya lagi utk next season utk rebut kasut emas lagi."

Selepas ini Noorshahrul terpaksa pula berlatih bersama skuad kebangsaan untuk perlawanan persahabatan antarabangsa menentang Chelsea, Liverpool dan Arsenal serta perlawanan kelayakan Piala Dunia menentang Singapura. 3 hari sebelum perlawanan menentang Sabah, Noorshahrul beraksi dalam perlawanan kelayakan Piala Dunia menentang Taiwan di Taipei pada Ahad 3 July 2011 di mana beliau membantu Malaysia layak ke pusingan seterusnya dengan agregat 4-4, meskipun tewas 2-3 di Taipei.

Shisha smoking is banned in Kota Bahru, Kelantan, Malaysia

Media reported today 22nd February 2011 that the Kota Baru Municipal Council has banned all food outlets there from allowing shisha smoking at their premises with immediate effect.

Its secretary Mohd Anis Hussein said this was provided for under local licensing by-laws.

"Enforcement action will be taken against outlets not heeding the ban," he told Bernama, the Malaysian national news agency.

Meanwhile, Kelantan mufti Datuk Mohamad Shukri Mohamad said the state fatwa council was awaiting a ruling on the matter from the National Fatwa Council so that there could be uniformity in all states.

The World Health Organisation (WHO) announced in 2007 that a single session of smoking shisha yielded a nicotine intake equivalent to more than one pack of cigarettes.

It said shisha smoke retained all the carcinogens of cigarette smoke while adding more carbon monoxide and a separate set of carcinogens from the use of burning coals to keep the nicotine flowing, coupled with the risk of infection with tuberculosis or hepatitis from shared mouthpieces.

Meanwhile Middle East experts said smoking Shisha is 200 times worse than smoking a cigarette.

And a typical hour long shisha session involves inhaling 100 to 200 times the volume of smoke inhaled when smoking a cigarette and there is no proof that any adaptation can make waterpipes safer.

So... stop smoking Sisha and cigarettes because both are bad for your health... !!!

Tengku Razaleigh may be Barisan candidate for Galas by-election, Malaysia

Tengku Razaleigh Hamzah, has a long and solid political background. He is almost impposible to beat in an election. Tengku Razaleigh can win in any election, regardless of which political party he represents.

In the 1969 general election, Tengku Razaleigh won the Parliamentary seat of Kelantan Barat.

In 1971, he was elected to the UMNO Supreme Council, and was elected as a Vice-President of UMNO in 1975.

After Prime Minister Tun Abdul Razak's sudden death in 1976, he was appointed as Finance Minister by the new Prime Minister, Tun Hussein Onn.

Razaleigh's planning was reputed to have been the main reason the Barisan Nasional (BN) coalition, of which UMNO is a member, almost totally defeated the opposition Islamic party of PAS in the 1978 general election and the Kelantan state elections of the same year.

In 1987, Tengku Razaleigh made world history when he challenged the then Prime Minister Tun Dr Mahathir Mohamad for the post of UMNO President. In the tightly contested and internationally publicised election, Dr. Mahathir managed to retain his position. However, UMNO was split into two separate entities as Tengku Razaleigh was left unsatisfied with the result.

The split forced the Malaysian court to declare UMNO as illegal in 1988. Shortly after the court ruling, Dr. Mahathir reestablished UMNO as UMNO Baru (New UMNO), though the new UMNO was badly weakened.

Tengku Razaleigh at the same time went on his own path and found a new political party called Semangat 46 in 1989. The number 46 refers to the year UMNO was originally founded.

Seven years later in 1996, Tengku Razaleigh disbanded Semangat 46 and rejoined UMNO.

In 2004, he announced his interest for the UMNO top post yet again but failed to garner enough nominations to contest the presidency.

In Putrajaya today 1st October 2010, media reported that Deputy Prime Minister Tan Sri Muhyiddin Yassin hinted that Gua Musang Member of Parliament Tengku Razaleigh Hamzah might be fielded as the Barisan Nasional's candidate for the Galas by-election.

Muhyiddin said Barisan was willing to consider fielding the Umno veteran as he believed Tengku Razaleigh was the most suitable, based on his influence and long track record in Gua Musang.

Nevertheless, whether Tengku Razaleigh wanted to contest the seat or he wanted to propose someone else to be considered by the top leadership, was up to him.

"We have always made room for him to nominate candidates and if we think the person can win the seat, that person will be given priority," he told reporters after chairing of the National Social Council's executive committee in Putrajaya on Friday, 1st October 2010.

Muhyiddin was commenting on the call by Kelantan Umno Youth chief Anuar Safian for Tengku Razaleigh to be made the candidate for the Galas seat.

On PAS' claims that choosing Tengku Razaleigh would boost its chances of winning the seat because he was on their side in the matter of oil royalty due to Kelantan, Muhyiddin said PAS was actually "gundah-gulana" (in a dilemma).

"Actually they are at a loss because they know they can never take on Tengku Razaleigh in Gua Musang," he said.

"Tengku Razaleigh has a big influence with the Malay, Chinese, Indian and Orang Asli communites as their members all know him personally. As for the oil royalty issue no one is better qualified than Tengku Razaleigh to explain it," he said.

He said PAS became frightened when the Barisan announced Tengku Razaleigh as the election director for the by-election and now did not know what to do to put up a fight against the coalition.

The Galas state seat fell vacant following the death of its assemblyman Chek Hashim Sulaima, 46, from PAS, on Monday, 27th September 2010 due to cancer.

It is one of three seats in the Gua Musang parliamentary constituency with the other two being Nenggiri and Paloh.

The newly proclaimed Sultan of Kelantan, Sultan Muhammad V, has stripped his younger brother Tengku Muham­­mad Fakhry Petra of the royal title Tengku Temenggong.

The new Ruler also withdrew two royal awards bestowed on his brother by their father; the Darjah Kerabat Ahli Yang Amat Dihormati (DK) (Al-Yunusi) and the Darjah Kebesaran Mahkota Kelantan Yang Amat Mulia (SPMK) (Al-Muham­madi I).

Tengku Fakhry is the third child of the former Sultan of Kelantan, Tuanku Ismail Petra Al-Marhum Sultan Yahya Petra.

Tuanku Muhammad Faris, the eldest son of Tuanku Ismail, was proclaimed Sultan by the state Royal Succession Council on September 13, 2010.

State Secretary Datuk Seri Mohd Aiseri Alias said the new Sultan had his own reasons for making the decree affecting his brother, which took effect from yesterday.

The notice on the removal of the royal title and awards was served on Tengku Fakhry by a State Secretariat official to an employee of Istana Mahkota in Kubang Kerian at around 10am yesterday. The notice was made known to the prince in a letter, Aiseri told a press conference in Kota Baru on 30th September 2010.

The withdrawal of the title and awards also meant the removal of a royal allowance accorded to Tengku Fakhry when he was Tengku Temenggong.

Last week, the Controller of the Kelantan Royal Household, Da­­tuk Abdul Halim Hamad, announced that Tuanku Muhammad Faris was to be officially addressed as Sultan Muhammad V for matters pertaining to the palace and the state government to avert the use of various names.

Tengku Muhammad Fakhry has been embroiled in long-standing bitter rivalry with his eldest brother Tengku Muhammad Faris Petra when the latter was the Kelantan Regent.

Tengku Muhammad Faris was proclaimed the new Sultan of Kelantan by the State Royal Succession Council on Sept 13, 2010 and has assumed the name Sultan Muhammad V.

The Kelantan royalty issue - grabs the attention of the world

The Star today reported that a team of lawyers representing the Sultan of Kelantan has filed a writ of habeas corpus to seek the release of the state ruler from detention by police.

The newspaper reported that this is the first time in the world that such a writ was filed.

KUALA LUMPUR: In an unprecedented move, a team of lawyers has filed a writ of habeas corpus on behalf of the Sultan of Kelantan to immediately “free” him from the Universiti Sains Malaysia Hospital where he is currently warded.

The Special Court will hear the application on Monday, said one of the lawyers, Gobind Singh Deo.

Sultan Ismail Petra is heavily guarded at the hospital’s Royal Ward in Kubang Kerian, Kelantan, where he has been admitted since Tuesday.

The writ, which was filed at the Special Court in Putrajaya yesterday, is supported by an affidavit by the Sultan’s third son, Tengku Temeng-gong Tengku Muhammad Fakhry Petra.

The Special Court was set up in 1993 to hear cases involving royalty.

The writ names the Sultan of Kelantan as the applicant and lists five respondents – the Kelantan police chief, the Inspector-General of Police, the hospital director, the Health Ministry’s director-general and the Federal Government.

The six lawyers headed by Raja Aziz Addruse said they believed the Sultan was being held in the hospital against his will and should be released immediately.

All five respondents, they said, were responsible for the Sultan’s situation.

“We take the view that the Sultan is in hospital under restraint. That’s why we are seeking his release,” Raja Aziz said at a press conference yesterday, which was also attended by three relatives of the Raja Perem-puan of Kelantan Tengku Anis Tengku Hamid.

Raja Aziz, however, declined to explain why they felt the Sultan was under restraint.

“He is not a prisoner. But the habeas corpus applies not just to persons in prison but those who are restrained from exercising their rights of liberty. He is being detained against his will,” he added.

The others in the team are Datuk Haaziq Pillay, Datuk Param Cumara-swamy, Abdul Rashid Ismail and Malik Imtiaz Sarwar.

Param said this was the first time in the world a writ of habeas corpus had been filed to seek the release of a state ruler from detention by police.

Gobind Singh said Tengku Muhammad Fakhry had filed the affidavit as attempts to see the Sultan of Kelantan had failed. Tengku Muhammad Fakhry is not among the five people who are allowed to visit the Sultan.

Mursyidul Am Pas dan Menteri Besar Kelantan Datuk Nik Abdul Aziz Nik Mat berkata beliau tidak bersetuju dengan perkahwinan di bawah umur walaupun ia adalah sah dari segi agama.

Beliau berkata, Islam menggalakkan sesuatu perkahwinan untuk mendapatkan zuriat dan bukan semata-mata dilihat dari sudut untuk memuaskan nafsu dan amalan sunnah Nabi Muhammad, semata-mata.

"Seperti juga kita makan buah durian adalah untuk mendapatkan rasa nikmat isinya, dan membuang segala benda yang tidak mendatangkan faedah seperti kulit dan bijinya.

"Begitu juga dengan berkahwin kita digalakkan bagi mendapatkan zuriat yang baik hasil percantuman jenis. Jadi saya tidak setuju jika kahwin terlalu muda, bawah umur seperti itu," katanya.

Banyak cara lain yang boleh dilakukan untuk mengikut amalan sunnah Nabi, bukan melalui kaedah perkahwinan cara itu, katanya mengulas tindakan seorang bapa dari Jelawang, Jeli, yang mengahwinkan anak perempuannya berusia 11 tahun dengan lelaki berusia 41 tahun, kononnya tuntutan sunnah Nabi.

Ini adalah kejadian kedua membabitkan pernikahan budak perempuan di bawah umur di negeri itu selepas kejadian pertama membabitkan seorang bapa mengahwinkan anak perempuannya berusia 10 tahun di Pasir Mas sebelum ini.

Nik Aziz berkata beliau hairan kejadian itu boleh berlaku sedangkan kerajaan negeri sudah membuat peraturan melalui Enakmen Keluarga Islam yang mensyaratkan setiap pasangan wanita berusia 16 tahun ke atas sebelum dibenarkan berkahwin mengikut enakmen itu.

Menurut laporan media, bapa kanak kanak malang berusa 11 tahun itu adalah seorang tabligh.

Apa rasionalnya dia berbuat begitu, tak diketahui.

Budak perempuan baru berusia 11 tahun sepatutnya menuntut dalam Tahun 5, belum cukup umur lagi... belum layak lagi ikut UPSR, apa lagi PMR, SPM dan STPM..

Budak itu juga tidak tahu apa itu hubungan suami isteri... sebaliknya dia hanya budak budak yang belum pun menempuh alam remaja!!!!!!!!!!

Yang dikahwinkan dengan budak itu pula lelaki tua bangka berusia 41 tahun!! Nasib baik bukan lelaki berusia 77 tahun atau 100 tahun atau 1 setengah Abad!!!!!!!!! Nak Mampus????????

Apa sudah jadi dengan bapa budak perempuan itu??? Adakah dia sudah gila atau hilang kewarasan dan hilang pertimbangan ataupun paksi kerasionalannya mengalami kerosakan teknikal yang maha teruk????????

Mengapa setiap kali hujan lebat dan berlaku limpahan air sungai Golok, hanya Kelantan yang terkena tempiasnya – dengan berita banjir di merata Jajahan seperti Tumpat, seringkali menghiasai dada akhbar dan juga laporan berita televisyen.

Kita tahu, ada banyak juga penempatan di sepanjang sungai Golok di sebelah Thailand…. Tetapi adakah kawasan di Thailand itu turut dilimpahi air Bah atau Banjir??

Adakah ini bermakna, system pencegahan banjir di Thailand lebih efektif dari Kelantan atau Malaysia amnya???
